This is a re-post. Any news that may help my situation? My ex-spouse has been ignoring payments on our SMART Loan as layed out in our divorce decree. Just as I get close to getting her garnished, she has filed for Chapter 13 Bankruptcy. I know the loan cannot be brought into the filing, but does anyone have any advice for how I can still get her monthly obligation for the payment included in the Bankruptcy plan? Am I out of luck?

I think you might be better off consulting your lawyer on this one. Any information you obtain here should be verified with your lawyer anyways. Laws vary from state to state anyways.
